Click & Retail Solutions BVBA, located at Rijnkaai 28, 2000 Antwerpen, with company registration number BE0719.283.011 (hereafter “COLLECTIQUE”) is in charge of the control of your personal information.
1. If you are a customer of a partner webshop that offers the Collectique service
a. Which information should you give us and which information do we collect about you?
If you want to benefit from our services, you should give us your email address (and optionally, your phone number) through the relevant webform.
We also collect some of your personal information from the webshop from which you buy your items that you want us to take care of. This personal information comprises information on:
- your identity (name and surname)
- your contact details (address)
- the products you ordered on the webshop (product code, product name, price, size, colour, quantity)
- date of the order of your products
- status of the delivery of your ordered products
- reason for returning an ordered product
- the webshop through which you placed the order
- your chosen Collectique point
If you do not agree that we use this information, you should not request the provision of our Collectique services.
b. Why do we use your personal information?
We may use your personal information for the following purposes:
- to ensure that you benefit from Collectique points for the products you ordered on a partner webshop;
- to ensure that the return of the product(s) you ordered and that did not suit you is taken care of;
- for direct marketing purposes, after a specific and explicit permission was given, that can later be revoked at any time;
- for the maintenance of our platform;
- to follow up on any enquiries;
- for the establishment, exercise or defense of legal claims;
- to comply with laws and obligations we are subject to;
- to be able to make your rights described below exercisable.
c. Which processing ground(s) do we rely upon for processing your personal information?
In order to process your personal data, we rely on:
- our legitimate interests, being
- the performance of our services upon your acceptance of our general terms & conditions (allowing you to have access to Collectique points for the delivery of the products you ordered on a partner webshop);
- direct marketing, after a specific and explicit permission was given, that can later be revoked at any time;
- the efficiency and functionality of the platform (including but not limited to maintenance, bug fixes);
- the prevention of fraud;
- the necessity for the establishment, exercise or defense of legal claims.

d. How long do we keep your data for?
We retain your personal data for the duration required for achieving the purposes stated above under point b.
e. Where and whom will your personal information be transferred to?
Your personal data are transferred:
- to the Collectique points you chose for the delivery of your order(s).
- to external service providers that process your personal information for us and on our behalf, based on our instructions and in compliance with applicable privacy laws and regulations (a list of such providers is available upon request);
- to regulatory or law enforcement agencies if we believe in good faith that we are required by law to disclose it in connection with the detection of crime, the collection of taxes or duties, in order to comply with any applicable law or order of a court of competent jurisdiction, or in connection with legal proceedings;
- to third parties as part of a merger, acquisition or bankruptcy, in the event we sell or transfer all or a portion of our business or assets (including through bankruptcy).
We do not transfer your personal data outside the European Union.
2. If you are working for a webshop or for a Collectique point
a. Which information should you give us and which information do we collect about you?
If you are working for a webshop, brand or store which has entered into a collaboration agreement with Click & Retail Solutions or which might be interested in such a collaboration, it may have provided us with:
- your name and surname
- your email address
- your mobile phone number
- the webshop / Collectique points which you work for
- your position
If no collaboration agreement has been entered into yet and if you are considering entering into a collaboration agreement with us, you should provide us with the same information through our dedicated web form.
b. Why do we use your personal information?
We use your personal information for the following purposes:
- to ensure an effective and efficient execution of the collaboration agreement between Click & Retail Solutions and the webshop or Collectique point you are working for (i.e. taking care of the delivery/return of the products purchased by customers).
- for our administrative and accounting purposes;
- for direct marketing purposes, after a specific and explicit permission was given, that can later be revoked at any time;
- for the maintenance of our platform;
- to follow up on any enquiries;
- to comply with laws and obligations we are subject to;
- to be able to make your rights described below exercisable.
c. Which processing ground(s) do we rely upon for processing your personal information?
In order to process your personal data, depending on the situation, we rely on:
- our legitimate interests, being
- the execution of the collaboration agreement entered into with the webshop / Collectique point you work for;
- direct marketing;
- the efficiency and functionality of the platform (including but not limited to maintenance, bug fixes);
- the prevention of fraud;
- the necessity for the establishment, exercise or defense of legal claims.

d. How long do we keep your data for?

- to your partner Collectique points or webshops, as required for the performance of the collaboration agreement.

3. If you are a website visitor who fills in a form on this website
You should only give us the information required into the dedicated fields. Your personal data will only be used for the purposes mentioned in the form and to contact you for a potential follow-up on your request.
We process this personal data based on your consent, which can be withdrawn at any time by sendingan email to privacy@collectique.eu. We will only keep your data for the duration required for achieving the purposes stated in the webform and we will only transfer your personal data:
- to external service providers to process your personal information for us and on our behalf, based on our instructions and in compliance with applicable privacy laws and regulations;

4. Which rights do you have over your personal data?
You have the right to ask us via our email address privacy@collectique.eu for:
- accessing your data;
- rectifying your data;
- withdrawing your consent if the processing of your personal data is based on your consent;
- the portability of the data you provided to us;
- restricting the processing of your data;
- erasing your data.

5. Are my data used and transferred outside the EU (or transferred to third parties)?
First and foremost, your personal data are processed for internal use. We can assure you that personal data are not sold, transferred or communicated to third parties that are linked to us, except in the following cases:
- When there is an explicit permission from the data subject;
- When transferring the data is necessary for the performance of the agreement. This will be the case for employees, agents, subcontractors, suppliers, commercial parties, marketing services, etc.;
- When transferring the data is necessary for the closure or performance of an agreement that is in the interest of the data subject, between the controller and a third party. For example in case of fraud;
- When transferring the data is necessary or a legal obligation.
Data subjects can be reassured of the confidential nature of the processing of personal data in case of an acquisition or sale of Collectique. In this case, Collectique will provide all the necessary information to the data subjects.
Collectique is a Belgian company. There can be a processing or transfer of personal data to countries outside the European Union. According to article 21 of the privacy law, personal data can only be transferred to countries that have a similar and sufficient level of data protection and where the same or similar provisions of the privacy law are complied with. The country, duration of the transfer and storage, the nature of the data and the exact purpose are criteria that need to be examined on a case by case basis.
Collectique guarantees that there will be no transfer of data to third countries for data processing or storage without the necessary measures in place to comply with the security levels required by the Belgian Privacy law.
6. Security measures
Collectique has the necessary technical and organisational measures, security measures and guarantees in place to process your personal data in compliance with the Belgian and European regulations, and in particular, without being limited to, to protect your personal data against loss, incorrect use or unauthorized changes. Collectique takes care of the security of the back office, amongst others. Collectique deploys a team of technical people, automised systems and advanced technology in compliance with the best practices within the sector to offer your personal data the right level of protection. Collectique undertakes all the necessary efforts to protect the confidentiality of your personal data.
Despite the aforementioned measures of Collectique, you need to be aware that there are always certain risks linked to sending personal data via the internet. The security and protection of your personal data can never be fully guaranteed.
In no event, Collectique can be held responsible for any direct or indirect damage occurred from an incorrect use or unauthorized use of the personal data by a third party.
7. Liability
Collectique cannot be held responsible for the unlawful or incorrect use of your personal data by third parties, when Collectique has transferred these personal data in a lawful and correct way.
Collectique is not liable for direct or indirect damage occurred from the incorrect or unlawful processing or use of your personal data by a third party.
In any event, Collectique can only be liable for damage that is caused by a processing of data, when the processing did not comply with the provisions under the GDPR. Collectique is never liable for any unusual, incidental, indirect or consequential damage.
